XTREME AUTO TOPS (MFG)) warrantseach new XTREMEconvertible top to the originalowner as follows:
LIMITED LIFETIME:
- If the bond between the topping material and the glass window fails a new replacement top of the same or similar material will be made available to the original owner on a pro rata deductible basis as follows:
Failure during the first 36 months of usethere is no deductible charge
Failure after 36 months of use there is adeductible charge of 50% of the then current MSRP
FOR A PERIOD OF THREE(3) YEARS FROM THE DATE THE UNIT IS DELIVERED TO THE FIRST RETAIL PURCHASER:
·Crackingor breaking of plastic components (excluding plastic windows)
·Delaminationof the deck seams
·Failureof the stitching (excluding fading)
·Delaminationof the topping material
·Delaminationof the bond between the topping material and the plastic window
ITEMS NOT COVEREDUNDER WARRANTY FOR ANY PERIOD:
·Rips,tears, or discoloration of the topping material
·Sealsand gaskets
·Dealerand/or purchaser installed parts and accessories
·Removal and re-installationon the vehicle
·Glasswindow breakage or cracking
·Zippersand fasteners
·Plasticwindow scratching, fading, cracking, hazing or discoloring
CERTAIN CONDITIONSWILL VOID ALL WARRANTY.
These conditions include:
·usefor any purpose other than normal private use including rental and promotion
·alteringthe convertible top in any manner without written approval of the MFG
·misuse,negligence or accident
·installationof any part or accessory without written approval from the MFG
CLAIMPROCEDUREIfa part fails, the purchaser must contact the selling dealer or installer todetermine if the failed part is covered under the terms of this warranty. Thedealer will then contact their XTREME AUTO TOPS distributor to process thewarranty. Xtreme Auto Tops will determine if the claim is covered by thiswarranty and if so, will ship a replacement top to the location as specified bythe distributor. The owner will be responsible to pay the deductible charges,if any, to the selling dealer/installer. If it is impractical for the purchaserto return to the selling dealer, then the purchaser may contact the XTREME TechnicalAssistance Help Desk to determine warranty eligibility. Labor costs to replace defective parts are the responsibility of the ownerand no reimbursement for labor will be provided by Xtreme Auto tops.
CONDITIONSAND LIMITATIONSThis warranty is subject tocertain conditions and limitations including, but not limited to, thefollowing:
·Anypart of an Xtreme convertible top that is found to be defective under the termsof this warranty will be repaired or replaced using either new or reconditionedparts at the discretion of the MFG.
·Indetermining what constitutes a failure under the terms of this warranty thedecision of the MFG shall be final.
·Thiswarranty is extended to the original purchaser only and is not transferable tosubsequent purchasers.
·TheMFG does not accept any responsibility in connection with the installation ofany of its products by its dealers or agents.
·TheMFG does not undertake responsibility to any purchaser for warranty express orimplied by any of its dealers, distributors or agents beyond that which iscontained herein.
·Withoutregard to an alleged defect of its products the MFG, under any circumstances,does not assume responsibility for loss of time, inconvenience, revenue, orother consequential damage including, but not limited to, expenses fortelephone, food, lodging, travel, loss or damage to the vehicle the productsare installed on or loss or damage to personal property of the purchaser oruser of the products.
