ENGINEQUEST LLC LIMITED WARRANTY:
Original EquipmentManufacturer (OEM) Type Replacements- Subject to the terms of this warranty, ENGINEQUEST LLC warrants to theoriginal purchaser that for 12 months from date of purchase from ENGINEQUEST orthe length of the engine warranty, whichever is earlier, the product sold by uswith this warranty shall be free of defects in material and workmanship undernormal use and with periodic maintenance as recommended by the OEM subject tothe following terms and conditions.
NonOEM-Type Replacements (including those designed for racing, performance and hot rodapplications)- Subject to the termsof this warranty, ENGINEQUEST LLC warrants to the original purchaser that atthe time of purchase, the product sold by us with this warranty shall be freeof defects in material and workmanship. FOR CLARITY, THIS WARRANTY IS NO LONGERVALID AND ENGINEQUEST SHALL HAVE NO LIABILITY ONCE THE NON OEM-TYPE REPLACEMENTPRODUCT IS INSTALLED, MODIFIED OR USED.

REMEDY: Subject tolimitations listed herein, ENGINEQUEST, at its option, shall repair or replacea product during the warranty term after determination by ENGINEQUEST that theproduct is defective. In the alternative, at ENGINEQUEST’S option, ENGINEQUESTmay refund the actual purchase price received by ENGINEQUEST for such product.These are the sole remedies available to purchaser. All repairs or replacements covered by thiswarranty must be authorized in advance by ENGINEQUEST. We assume no liabilityunless we are contacted before any work is done and agree in writing that it isauthorized to be performed. The warranty period is not extended if ENGINEQUEST repairsor replaces the product.
LIMITATIONS: This warranty onlyapplies to products originally supplied directly by ENGINEQUEST. This warranty isnot transferrable and does not apply to or include any of the following: (1) damage as a result of an act of God, misuse,abuse, accident, over-heating, lack of lubrication, contamination, or improperuse, installation, operation or maintenance; (2) repair or replacementof any accessory or service item, including but not limited to: (a) allcomponents of the cooling, fuel, electrical and ignition systems; and (b) all belts, hoses, and filters; (3) anyproduct used for competition, racing, performance, hot rod or similar or relatedpurposes; (4) any product to which a device or accessory not conforming tooriginal manufacturer's specifications has been installed or removed; (5) any producton which periodic maintenance services required by the OEM have not beenperformed; and (6) any product that has been modified or disassembled without theprior written authorization from ENGINEQUEST. To be valid, crankshaft warrantyrequires installation of new harmonic balancer at time of crankshaftinstallation.
LIMITED LIABILITY: ENGINEQUEST SHALL NOT BE LIABLEFOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS ORPRODUCTION OR COMMERCIAL LOSS IN ANY WAY (including, without limitation, forrental cars or towing fees), REGARDLESS OF WHETHER SUCH CLAIM IS BASED INCONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OFLIABILITY, EVEN IF ENGINEQUEST HASBEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Further, in no event shall theliability of ENGINEQUEST exceed the individual price of the product on whichliability is asserted.
STANDARD REIMBURSEMENT FOR LABOR: The amount of Labor credit for repairs willbe determined by multiplying the standard labor rate per hour (based on yourarea, not to exceed $40.00 USD) by the factory time shown in Chilton's and Motor's manuals. Not to exceed $250.00.
LAW:These terms are governed by Nevada law withoutgiving effect to any choice or conflict of law provision or rule (whether ofthe State of Nevada or any other jurisdiction) that would cause the applicationof the laws of any jurisdiction other than those of the State of Nevada.. There are no third-party beneficiaries. Thiswarranty gives you specific legal rights, and you may also have other rightswhich vary from state to state.
No dealer nor any agent or employee thereof, isauthorized to extend or modify this warranty. This warranty may be distributedin a state(s) which may not allow the limitation or exclusion of somewarranties or of incidental or consequential damages. In the event that anyprovision of this warranty should beor become invalid or unenforceable, the remaining terms and conditions hereofshall remain in full force and effect. All returns must be accompanied by aReturn Goods Authorization (RGA) issued by Customer Service.
